Terms Of Service
These Terms of Service govern your use of the Iyanko Online Store web app , operated by Iyanko Online Store, a PACRA-registered entity in Zambia. By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App. The App is currently available only to users in Zambia.
Acceptance and Eligibility
- You must be at least 14 years old to use the App. If you are under 14, you are not permitted to register or use the App.
- By using the App, you represent that you meet the age requirement, provide accurate information, and agree to comply with these Terms and Zambian laws, including the ECTA and CCPA.
Description of Services
The App is an e-commerce platform connecting buyers and sellers in Zambia. Features include:
- Buyer registration to browse location-based products, place orders, and track progress.
- Seller registration: Submit (PACRA documents and tax clearance or by physically checking the sellers store), NRC, email, phone, and selfie for admin verification to open stores.
- Order facilitation: No in-App purchases; payments handled externally between buyers and sellers.
- Seller payments: Sellers pay us via in-App methods (processed by Pesapal) for App usage, including fees for listings and a percentage of completed orders.
- Verification: SMS codes sent via Africa's Talking for sensitive pages. authentication with google emails used for regular users and store access.
We reserve the right to modify services with notice. No advertisements are displayed on the platform.
User Accounts
- Registration requires accurate information and verification
- You are responsible for account security (e.g., passwords) and all activities.
- Sellers: Verification is at our discretion; false documents may lead to rejection or termination.
- We may suspend or terminate accounts for violations, non-payment, or other reasons.
User Conduct and Responsibilities
- Prohibited: Illegal activities, harassment, spam, uploading harmful content, or violating intellectual property.
- Buyers: Use for legitimate orders; respect seller terms.
- Sellers: Provide accurate product info; handle orders promptly; comply with Zambian consumer laws (e.g., no unfair disclaimers under CCPA).
- Content: You grant us a license to use uploaded content (e.g., product listings) for App purposes. You retain ownership but warrant it doesn't infringe rights. Location Data: Consent to use for personalization.
Payments and Billing (Sellers Only)
- Listing and Video Fees: Based on the number of items posted. Charged monthly but calculated and added daily as a fraction of the monthly rate (e.g., if K10 per listing per month, daily charge is K10 / 31). If a listing is deleted, it is no longer billed from that day.
- Order Fees: A small percentage of the total amount from completed orders, added to your bill.
- ROI: A small percentage of the total charge for the seller is added. (for Iyanko's advertising services on behalf of sellers)
Billing Cycle: Fees are aggregated and payments due monthly via Pesapal. You authorize automatic charges.
Refunds: No refunds for partial months or deleted listings, except in cases of our error. Overdue payments may result in account suspension.
Taxes: You are responsible for all applicable Zambian taxes on fees and orders.
We do not handle buyer payments; any disputes over orders are between buyers and sellers but iyanko will assist with any necessary information to resolve any disputes.
Intellectual Property
- We own all App content, logos, and software. You get a limited, revocable license to use the App.
- Do not copy, modify, or reverse-engineer.
Disclaimers and Limitation of Liability
- The App is provided "as is" without warranties. We are not liable for external payments, order disputes, product quality, or seller/buyer interactions (as a connector only).
- Under ECTA, we limit liability for service provider actions (e.g., no liability for transmitted data unless we modify it).
- To the extent permitted by Zambian law, our liability is limited to direct damages, not exceeding fees paid in the last 12 months.
- You indemnify us against claims from your use, content, or transactions.
Termination
- You may close your account anytime, but outstanding fees remain due.
- We may terminate for violations, non-payment, or other reasons, with notice where possible.
Governing Law and Dispute Resolution
- Governed by laws of the Republic of Zambia.
- Disputes: First, attempt informal resolution via [email protected]. or by reporting the store directly within the app. If unresolved, submit to courts in Lusaka, Zambia.
- Consumers: Your rights under CCPA (e.g., fair trading) are preserved.
Changes to Terms
We may update Terms with notice. Continued use accepts changes.
